Terms of service

Welcome to Liberté de Luxe, operated by MJ Living KLG (CHE-223.565.886), Mettenfeld 21, 5642 Mühlau, Switzerland ("we", "us"). These Terms govern your use of liberteluxe.com and any purchase made through it. By placing an order you accept these Terms.

1. Contract Formation
   Your order is an offer to buy. A binding contract is formed only once we send you an order confirmation email. We may decline or cancel an order (e.g. stock unavailability, pricing errors, suspected fraud) before that point without liability beyond refunding any amount already paid.
   
   
2. Eligibility
   By ordering you confirm that you are at least 18 years old, or that you have the consent of a parent or legal guardian to enter into this contract.
   
   
3. Products
   We describe products as accurately as possible. Colours may vary slightly depending on your screen. Product images are illustrative. Minor deviations that do not affect the product's usability do not constitute a defect.
   
   
4. Prices & Payment
   All prices shown at checkout are final prices in the displayed currency. MJ Living KLG is not currently registered for VAT in Switzerland (turnover below the mandatory threshold); no separate VAT is added at checkout. Depending on your delivery country, import duties or taxes may apply — see our Shipping Policy. Payment is processed by our payment providers (credit card, PayPal, Klarna, Apple Pay, Google Pay); we do not store your full card details ourselves.
   
   
5. Shipping

6. Right of Withdrawal & Returns
   If you are a consumer resident in the EU/EEA or UK, you have a statutory 14-day right of withdrawal; we additionally grant all customers a voluntary 30-day return window. Full details, exceptions, and the withdrawal form are in our Refund & Right of Withdrawal Policy
   
   
7. Retention of Title
   Delivered goods remain the property of MJ Living KLG until paid in full.
   
   
8. Liability
   We are liable without limitation for damage caused intentionally or by gross negligence, and for injury to life, body, or health, and under any mandatory product liability law. For slight negligence, our liability is excluded to the extent permitted by law. We are not liable for indirect or consequential damages (e.g. loss of profit) except where caused intentionally or by gross negligence.
   
   
9. Intellectual Property
   All trademarks, logos, product names, text, and images on this site belong to MJ Living KLG or its licensors. No use without our prior written consent.

11. Changes to these Terms
    We may update these Terms from time to time. The version published on our website at the time of your order applies.
    
12. Governing Law & Jurisdiction
    These Terms are governed by Swiss law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in the EU/EEA or UK, this choice of law does not deprive you of any mandatory consumer-protection rights under the law of your country of residence, and nothing here overrides the jurisdiction rights you have as a consumer under the Lugano Convention or applicable EU regulations.
    
    
13. Severability
    If any provision of these Terms is invalid, the remaining provisions stay in effect.
